Scope:

This Privacy Policy (the “Policy”) applies to Logel Homes’ customers and clients in Canada, visitors to our website or any other digital distribution service or mobile application on which we provide this Policy (collectively, the “Services”). For purposes of this Policy, Logel Homes is defined as all related projects under Logel Homes licensing/branding, including without limitation Auburn Rise Ltd., Sage Walk Ltd. and Seton West Ltd.

Our Business

We recognize privacy is important to our users. This Policy describes how and why we collect Personal Information in the course of providing the Services, and how that data will be used and shared with third parties.   1. What is Personal Information?

"Personal Information" means any information about an identifiable individual or an individual whose identity may be inferred or determined from such information. “Personal Information” does not include business contact information if used solely for the purpose of contacting the individual in relation to the individual’s business responsibilities.

We may collect the following Personal Information when you contact us, register with us, use our services or otherwise provide us with information about you:

  • full name;
  • contact information, including your email address, phone number and address;
  • possession date;
  • Alberta New Home Warranty Program number;
  • company, job title and business contact details;
  • nickname/user name;
  • contact preferences;
  • information generated in the course of your use of the Services, including without limitation, your level of interest in our Services;
  • information you may submit to us voluntarily during your use of the Services and/or communications with us, including your preferences, timelines and lifestyle details;
  • identity information (which may include birthday and SIN); and
  • information about you that may be provided to us by third parties where they have your consent to do so or where otherwise permitted by law.

Automatically Collected User Information

We obtain certain information about your use of our website. This information is collected when publishers, advertisers, and ad networks use the Logel Homes platform. Additionally, certain other information (such as cookies, described below) may be transmitted by our Web server to your computer. Specific types of usage information that may be collected automatically are described below:

  • information about how, when and where you use Our Services;
  • the hardware and software you use to interact with Our Services;
  • your device identifier;
  • your mobile network information;
  • the settings you use on Our services;
  • your network location;
  • your IP address; and
  • information about the webpages you visited prior to coming to our website.
  1. How do we collect your Personal Information?

We only collect Personal Information for purposes that would be considered reasonable in the circumstances and only such information as is required for the purposes of providing our Services. We use only fair and lawful methods to collect Personal Information.

    Unless permitted by law, no Personal Information is collected, without first obtaining the consent of the individual concerned in the collection, use and disclosure of that information. By using our Services, or otherwise interacting with us, you consent to the collection, use and disclosure of your Personal Information by Logel Homes in accordance with the terms of, and for the purposes set out in, this Policy. We may seek consent to use and disclose Personal Information after it has been collected where we wish to use the information for a new or different purpose where the individual concerned has not already consented to such a use of their Personal Information.

  2. Withdrawing your consent

    In most cases and subject to legal and contractual restrictions, you are free to refuse or withdraw your consent at any time upon reasonable, advance notice. Your withdrawal of consent will not operate retroactively. In certain circumstances, our Services can only be offered if you provide us with your Personal Information. Consequently, if you choose not provide us with the required Personal Information, we may not be able to offer you certain Services. We will inform you of the consequences of the withdrawal of consent.

  1. Cookies and tracking technologies

Cookies, Log Files and Similar Technologies  

As you interact with our website, we may automatically collect technical data about your equipment, browsing actions and patterns. We collect this information by using cookies, server logs and other similar technologies. We use Cookies to collect usage information when you visit our website to enhance user experience on our website and to serve advertisements to users. Cookies are small text files placed on your hard drive that assist us in providing a more customized website experience. It is our policy to use cookies to make navigation of our website easier for users. In order to properly manage our website we may anonymously log information on our systems, and identify categories of users by items such as domains and browser types. These statistics are used to manage the operational efficiency of our systems. We also use this information for Facebook Ads Manager, Google AdWords, Google Analytics and similar technology. For example, this website uses the Google AdWords remarketing service to advertise on third party websites (including Google) to previous visitors to our site. This could be in the form of an advertisement on the Google search results page, or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on someone’s past visits to the Logel Homes website.

  1. How do we use your Personal Information?

Logel Homes uses the data collected from customers and website users, including without limitation, Personal Information, in order to:

  • provide you with our Services;
  • carry out marketing and analytical purposes, including remarketing as outlined at section 4 of this Policy;
  • provide you with support and handle inquiries;
  • improve the quality and functionality of our website, enhance your experience, create new services (including customized services), change/cancel existing content and services, or for statistical purposes;
  • ensure that our website remains functioning and secure;
  • generate anonymized or aggregated data which we may use and disclose for our business purposes in our sole discretion;
  • as required by the Alberta New Home Warranty Program (ANHWP), and as part of providing the ANHWP warranty protection coverage and services to you;
  • comply with legal requirements and applicable law including, without limitation, the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC), and assisting law enforcement agencies as required; and
  • as permitted by applicable privacy law.

Our use of Personal Information is limited to the purposes described in this Policy. We do not otherwise sell, trade, barter, exchange or disclose for consideration any Personal Information we have obtained.

  1. How do we share your Personal Information?

Logel Homes may transfer or disclose the data collected from customers and website users, including Personal Information, to the following parties:

  • The Alberta New Home Warranty Program;
  • Our lenders;
  • The following third party services providers: Customer Insight, for purposes of conducting surveys; and Lasso Data Systems, a CRM platform through which we manage registrants;
  • Other third party service providers, including without limitation, cloud service providers, payment providers, survey providers, advertising, marketing and analytics services providers, and other service providers such as individuals or organizations who are, or may be, involved in maintaining, reviewing and developing our systems, procedures and infrastructure including without limitation, testing or upgrading of our systems, who in turn use the information in accordance with our instructions and applicable law;
  • Our legal and other advisers as permitted by applicable law;
  • In the context of a business transaction, we reserve the right to transfer any Personal Information we have in the event that we merge or are acquired by a third party or should a third party acquire all or part of our business or should any such transaction be proposed, in accordance with applicable laws; and
  • As permitted by applicable law.
  1. How long do we retain your Personal Information?

We keep your Personal Information only as long as it is required for the reasons it was collected.  The length of time we retain your Personal Information varies, depending on the purpose for which it was collected and the nature of the information. This period may extend beyond the end of your relationship with us but it will be only for so long as it is necessary for us to have sufficient information to respond to any issues that may arise at a later date. When your Personal Information is no longer required for the purposes for which it was collected, we will destroy, delete, erase or convert it into an anonymous form. If we learn that we have unintentionally stored personal information, we will use commercially reasonable efforts to anonymize or purge this information.

  1. How do we store and protect your Personal Information?

Information that we collect is stored on a single server located in Canada that Logel Homes solely manages, using industry standard physical, technical and organizational security procedures and practices appropriate to the nature of the information, in an effort to protect information from unauthorized access, destruction, use, modification, or disclosure. We do not transfer Personal information outside Canada.

We further protect your Personal Information by restricting access to it to those employees that require access to the information in order to provide our Services. Our employees use designated usernames and passwords, with different permissions depending on the role. Sales and financial related data and contracts, which may contain Personal Information, are stored in a permissions-based accounting folder and locked cabinets that only senior level employees have permission to view and enter. Other documents containing Personal Information are kept on encrypted laptops and/or locked cabinets at our sales centres. We caution that, while we endeavor to secure your Personal Information, no network, system or server is 100% secure.

Personal Information that is shared with third parties (as described above) is safeguarded by such parties in accordance with their privacy policies.   1. What do we do in case of a privacy or security breach?

A “breach of security safeguards” is defined as the loss of, unauthorized access to or unauthorized disclosure of Personal Information resulting from a breach of an organization’s security safeguards or from a failure to establish those safeguards. In case of a breach of security safeguards involving your Personal Information under our control, we will notify you and the applicable Information and Privacy Commissioner(s), as appropriate, if it is reasonable in the circumstances to believe that the breach creates a real risk of significant harm to you, including physical, financial or reputational harm. We will keep a record of all breaches in accordance with our legal obligations.

  1. How can you access or correct any inaccuracies in your Personal Information?

Logel Homes endeavors to ensure that any Personal Information provided and in our possession is as accurate, current and complete as necessary for the purposes for which we use that information. If we become aware that Personal Information is inaccurate, incomplete or out of date, we will endeavor to correct such inaccuracy. 

Logel Homes permits the reasonable right of access to and review of Personal Information held by us about an individual and will endeavour to provide the information within a reasonable time in accordance with applicable law, generally no later than 45 days following the request. To guard against fraudulent requests for access, we may require sufficient information to allow us to confirm that the person making the request is authorized to do so before granting access or making corrections. Your access to and review of Personal Information may be limited or restricted to protect our confidential business information, solicitor-client privileged information, or the Personal Information of other individuals, as permitted or required by applicable laws.

We may provide links to, or automatically produce search results for, third-party websites or resources, or third-party information referencing or linking to third-party websites or resources. Logel Homes has no control over such third-party websites and resources, and you acknowledge and agree that Logel Homes is not responsible for the content or information contained therein. When you follow such a link, you are no longer subject to our Policy, and we encourage you to read the privacy statements or other disclaimers of such other parties. Logel Homes is not responsible for the privacy or security practices or the content of external websites, services or products.

Logel Homes cannot and does not guarantee, represent or warrant that the content or information contained in such third-party websites and resources is accurate, legal, non-infringing or inoffensive. Logel Homes does not endorse the content or information of any third-party website or resource and, further, Logel Homes does not warrant that such websites or resources will not contain viruses or other malicious code or will not otherwise affect your computer.
